Yesterday Dr Zahi Hawass was sentenced to one year in prison over the Egyptian Museum Gift Shop case.

As I reported last month, it was expected that Hawass would receive a one year jail sentence for ignoring an earlier court verdict in June last year that ordered the gift shop not to be opened under a contract with the Sound & Light company.
Como se informó el mes pasado, se esperaba que Hawass fuera sentenciado a un año de cárcel por ignorar un fallo judicial de junio del año pasado en virtud de un contrato con la compañía de Luz y Sonido, ya que la tienda de regalos no se abrió.
Yesterday the court did just that and sentenced the Minister of State for Antiquities Affairs to a year in jail adding that he must also be relieved of his governmental duties and pay a 10 000 Egyptian pound fine.
Ayer, el tribunal así lo hizo y condenó al ministro de Estado para Asuntos de Antigüedades a un año de cárcel y agregó que también debe ser relevado de sus funciones gubernamentales y pagar una multa de 10.000 libras egipcias.
Yesterday's court ruling was appealed by Hawass' legal team and tomorrow they will present their case to the court. On the website of Dr Hawass he writes that the appeal is based on the fact that the bidding process for the gift shop was over by the time the court ruled and that therefore the ruling doesn’t apply.
La decisión de ayer de la corte fue apelada por el equipo legal de Hawass y mañana presentará su caso ante el tribunal. Ahram Online informó que el recurso se basa en el argumento de que debido a que el Museo Egipcio (aunque no la tienda de regalos en sí misma) contiene monumentos que deben ser tratados como tierras de propiedad del gobierno y por lo tanto se debía dar un tratamiento diferente de alguna manera.

En la página web del Dr. Hawass, escribe que el recurso se basa en el hecho de que el proceso de licitación de la tienda había terminado por el momento en que el tribunal falló y que por tanto la decisión no se debía aplicar.
However, last year’s court ruling was not made null and void simply because the bidding process was over by the time the court made it’s ruling as Hawass so confidently claims. Instead, the court ordered the cancellation of that auction and all the subsequent results of that auction. In other words, the granting of the contract to the Sound & Light company was illegal and therefore must be cancelled.I have to tell the world right now, there is a story going around that I am going to be in jail, which is a complete misunderstanding.
Hawass and the SCA at that time appealed that court verdict but in their appeal presented documents that were not legally acceptable due to the dates of signatures on those documents. It was because of this evidence that the court refused the appeal by Hawass and the verdict became final.
But Hawass went ahead and opened the new gift shop anyway in December last year against the court’s orders.
The Prime Minister even wrote to Hawass after the opening in January this year instructing him to implement the court order and to close the Egyptian Museum’s new gift shop. Hawass still refused and told the Prime Minister he would not implement the court order and later attempted to deny he received the Prime Minister’s letter.
Now the courts have given Hawass a one year jail term and he will once again appeal. Even if his appeal fails Zahi Hawass still has 10 days to close the Musuem’s new gift shop and apply the original court order.
Ahora los tribunales han dado Hawass un plazo de un año la cárcel y que apelará una vez más. Incluso si su apelación no prospera Zahi Hawass aún tiene 10 días para cerrar la tienda de regalos del Museo y solicitar la orden judicial original.
Zahi Hawass indica en su página web :
Tengo que decirle al mundo, que hay una historia dando vueltas que yo voy a ir a la cárcel, y es un completo malentendido.- Zahi Hawass.

Parece que Zahi Hawass y su equipo legal ha logrado poner fin a la decisión judicial con un decreto emitido por el tribunal.
En su página web www.drhawass.com/blog/decision-court-case-against-me escribe:
El Consejo Nacional de Administración de la Corte de Egipto emitió un decreto del 18 de abril de 2011 de aceptar una propuesta para detener el reciente fallo judicial en mi contra en mi anterior cargo de Secretario General del Consejo Supremo de Antigüedades, por un caso de la librería del Museo Egipcio. Este decreto especifica que no debo ir a la cárcel, y dice que me quedaré en mi cargo de Ministro de Estado de Antigüedades.
La apelación se llevará a cabo en el tribunal de apelación el 8 de junio. Si Hawass es capaz de demostrar en esa apelación que cumplió con la resolución del Consejo de Estado esta no tendrá efecto. Si se prueba que no ha cumplido con la resolución entonces la pena de prisión será segura.
